United Nations: Lula has the right to be a candidate

The High Commissioner for Humans Rights Secretariat of the United Nations requested the Brazilian government to allow Luiz Inácio Lula da Silva, 2018 presidential frontrunner, to have the right to be a candidate, access to the media, and to all members of his political party while being kept a prisoner. The decision follows a growing concern of the international community that Lula is a political prisoner in Brazil. Manifestos signed by globally known intellectuals have already stated that Lula is a victim of a fraud to halt democracy in Brazil. This week, Lula was formally registered as a candidate. Hours later numerous requests were made by the opposition to deny him this right.

Brazil legislation demands authorities to uphold UN Human Rights Council decisions. The situation in Brazil is so biased against Lula that he has been denied to give interviews from prison, even when assassins are entitled to that right. Lula is sentenced to almost 12 years in prison under "indeterminate acts".

While global quality papers such as "Financial Times" and "The Guardian" continues to describe Lula prison as an advancement of the Brazilian anti-corruption movement, the fact is there is absolutely no material evidence linking him with any illegal doing. On the contrary, after years of full-scale investigation, with thousands of hours of mainstream media reports, Lula was arrested because he was going to buy a flat ( described as luxurious beachside penthouse), what hi did not do. He has visited this flat only once for a couple of hours. Meanwhile, no political rival of Lula has lost any right so far. Even when millions of dollars in bags are found in their apartments or after they are wiretapped planning murders.

The long tradition of authoritarianism in Brazil, that dates back to colonialism, slavehood and dictatorship, has now imprisoned its most popular leader. Born in a desert with an infant mortality rate of 20%, Lula has created multilateral institutions such as the G-20, the Brics and Unasur.

Many hope now that the UN decision will bring Lula's foes who considered themselves Human Rights supporters to reason. It is necessary, for the sake of a fair and sustainable development, in Brazil and in the world, that the 2016 Coup in Brazil is reversed.

Comitê Internacional de Direitos Humanos determinou hoje que Lula deve ter livre acesso à mídia e não pode ter sua candidatura barrada antes de julgamento justo

Nota dos advogados do presidente Lula

Na data de hoje (17/08/2018) o Comitê de Direitos Humanos da ONU acolheu pedido liminar que formulamos na condição de advogados do ex-Presidente Luiz Inácio Lula da Silva em 25/07/2018, juntamente com Geoffrey Robertson QC, e determinou ao Estado Brasileiro que “tome todas as medidas necessárias para que para permitir que o autor [Lula] desfrute e exercite seus direitos políticos da prisão como candidato nas eleições presidenciais de 2018, incluindo acesso apropriado à imprensa e a membros de seu partido politico” e, também, para “não impedir que o autor [Lula] concorra nas eleições presidenciais de 2018 até que todos os recursos pendentes de revisão contra sua condenação sejam completados em um procedimento justo e que a condenação seja final” (tradução livre).

A decisão reconhece a existência de violação ao art. 25 do Pacto de Direitos Civis da ONU e a ocorrência de danos irreparáveis a Lula na tentativa de impedi-lo de concorrer nas eleições presidenciais ou de negar-lhe acesso irrestrito à imprensa ou a membros de sua coligação política durante a campanha.

Por meio do Decerto Legislativo 311 o Brasil incorporou ao ordenamento jurídico pátrio o Protocolo Facultativo que reconhece a jurisdição do Comitê de Direitos Humanos da ONU e a obrigatoriedade de suas decisões.

Diante dessa nova decisão, nenhum órgão do Estado Brasileiro poderá apresentar qualquer obstáculo para que o ex-Presidente Lula possa concorrer nas eleições presidenciais de 2018 até a existência de decisão transitada em julgado em um processo justo, assim como será necessário franquear a ele acesso irrestrito à imprensa e aos membros de sua coligação política durante a campanha.
